ACCEPTANCE OF TERMS

By accessing, using, or engaging with the services provided by Flat Fee Realty, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you (the "Client" or "you") and Flat Fee Realty ("Company," "we," "us," or "our"). If you do not agree to these terms in their entirety, you must not use our services.

These Terms of Service apply to all users of our services, including prospective clients, active clients, and visitors to our digital or physical properties. By scheduling a consultation, signing a service agreement, or otherwise engaging with Flat Fee Realty, you confirm your acceptance of these terms.

SERVICE DESCRIPTION

Flat Fee Realty provides straightforward real estate solutions focused on reducing commissions and offering cost-effective alternatives to traditional real estate services. Our services include, but are not limited to:

Flat Fee Buying & Selling Options: We offer real estate transaction services at predetermined flat rates rather than traditional percentage-based commissions. These services may include property listing, marketing support, transaction coordination, and related real estate activities as specifically outlined in individual service agreements.

Commission Reduction Strategy: We provide consultation and strategic planning to help clients minimize commission expenses in real estate transactions. This may include analysis of traditional commission structures, identification of cost-saving opportunities, and implementation of alternative compensation models.

Transaction Planning & Support: We offer guidance and support throughout the real estate transaction process, including but not limited to contract review assistance, timeline development, coordination with third parties, and general transaction management.

The specific scope of services, deliverables, and terms for each engagement will be detailed in a separate written service agreement. These Terms of Service govern the general relationship between Flat Fee Realty and all clients, while individual service agreements govern the specifics of particular engagements.

Our services are subject to applicable real estate laws and regulations. We reserve the right to refuse service to any prospective client, modify service offerings, or discontinue any aspect of our services at any time without prior notice.

USER OBLIGATIONS

As a client or prospective client of Flat Fee Realty, you agree to the following obligations:

Accurate Information: You will provide complete, accurate, and truthful information regarding yourself, your real estate needs, property details, financial capacity, and any other information reasonably requested by Flat Fee Realty. You acknowledge that our ability to provide effective services depends on the accuracy of information you provide.

Timely Communication: You will respond to communications from Flat Fee Realty in a reasonable and timely manner. You will notify us promptly of any changes to your contact information, property status, transaction timeline, or other material circumstances affecting your engagement with us.

Cooperation: You will cooperate fully with Flat Fee Realty and provide reasonable assistance in completing real estate transactions, including attending scheduled appointments, reviewing documents promptly, providing necessary documentation, and responding to requests from us or third parties involved in transactions.

Compliance with Laws: You will comply with all applicable federal, state, and local laws and regulations related to real estate transactions, including fair housing laws, disclosure requirements, and contract obligations.

Good Faith Conduct: You will act in good faith in all dealings with Flat Fee Realty, other parties to real estate transactions, and third-party service providers. You will not engage in fraudulent, deceptive, or illegal conduct in connection with our services.

Third-Party Service Providers: You acknowledge that real estate transactions typically require services from third parties such as title companies, inspectors, appraisers, lenders, and attorneys. You are responsible for engaging and compensating such third parties as needed, unless otherwise specified in a service agreement.

Property Access and Condition: For selling services, you will maintain the property in showable condition and provide reasonable access for showings, inspections, and appraisals as needed to complete the transaction.

APPOINTMENT SCHEDULING AND CANCELLATIONS

Flat Fee Realty provides consultation and support services that may require scheduled appointments, meetings, and property showings. The following policies govern scheduling and cancellations:

Scheduling: Appointments may be scheduled by contacting us at Owen.Peterson@flatfeerealty.info or through other designated scheduling methods. We will make reasonable efforts to accommodate your scheduling preferences, but cannot guarantee availability at any particular time.

Cancellation Notice: If you need to cancel or reschedule an appointment, you must provide at least 24 hours advance notice. Cancellations or rescheduling requests should be communicated via email to Owen.Peterson@flatfeerealty.info or by other confirmed communication method.

Late Cancellations and No-Shows: Cancellations made with less than 24 hours notice or failure to appear for a scheduled appointment without prior notice may result in a cancellation fee as specified in your service agreement. Repeated late cancellations or no-shows may result in termination of services.

Company Cancellations: We reserve the right to cancel or reschedule appointments due to emergencies, illness, scheduling conflicts, or other unforeseen circumstances. We will provide you with as much advance notice as reasonably possible and will work with you to reschedule at a mutually convenient time.

Third-Party Appointments: For appointments involving third parties such as property showings, inspections, or closings, you acknowledge that cancellation policies of those third parties may apply in addition to our policies.

PAYMENT TERMS

Flat Fee Realty operates on a flat fee pricing model designed to reduce your overall commission expenses. The following payment terms apply:

Fee Structure: Our fees are structured as flat rates rather than traditional percentage-based commissions. Specific fees for your engagement will be detailed in your individual service agreement. Fees may vary based on the scope of services, property type, transaction complexity, and other relevant factors.

Payment Schedule: Payment obligations, including amounts and timing, will be specified in your service agreement. Payment structures may include upfront fees, milestone-based payments, or fees due at closing, depending on the services selected.

Payment Methods: We accept payment by check, wire transfer, electronic payment, or other methods as specified in your service agreement. For services where fees are collected at closing, payment will typically be processed through the settlement or escrow process.

Late Payment: Any fees not paid when due may be subject to late payment charges of 1.5 percent per month or the maximum rate permitted by law, whichever is less. Unpaid balances may also result in suspension or termination of services.

Refunds: Refund policies, if applicable, will be specified in your individual service agreement. Generally, fees paid for services already rendered are non-refundable. In the event of transaction cancellation or service termination, you may be responsible for payment of fees for services provided up to that point.

Additional Fees: You are responsible for all third-party costs and fees associated with your real estate transaction, including but not limited to title fees, recording fees, inspection costs, appraisal fees, and attorney fees, unless otherwise specified in your service agreement.

Disputed Charges: If you dispute any charge, you must notify us in writing within 30 days of the charge. We will investigate disputed charges and work with you in good faith to resolve any billing issues.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, the following limitations on liability apply:

No Consequential Damages: Flat Fee Realty shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services, including but not limited to lost profits, lost opportunities, lost property value, emotional distress, or other intangible losses, even if we have been advised of the possibility of such damages.

Cap on Direct Damages: Our total liability for any claims arising out of or related to our services, whether based in contract, tort, negligence, strict liability, or other legal theory, shall not exceed the total amount of fees you paid to Flat Fee Realty under the applicable service agreement.

Real Estate Transaction Outcomes: We do not guarantee any specific outcomes in real estate transactions, including but not limited to sale price, time to sale, buyer qualification, transaction completion, or property condition. Real estate transactions involve numerous factors outside our control, and results cannot be guaranteed.

Third-Party Actions: We are not liable for the actions, omissions, errors, or negligence of third parties involved in your real estate transaction, including but not limited to buyers, sellers, other real estate agents, lenders, title companies, inspectors, appraisers, contractors, or attorneys.

Information Accuracy: While we strive to provide accurate information, we are not liable for errors or omissions in property information, market data, comparable sales information, or other information provided during our engagement, unless such errors result from our gross negligence or willful misconduct.

Market Conditions: We are not liable for changes in market conditions, interest rates, buyer demand, economic conditions, or other external factors that may affect your real estate transaction.

Legal and Tax Advice: We are not attorneys or tax professionals and do not provide legal or tax advice. We are not liable for any consequences resulting from legal or tax issues related to your transaction. You are encouraged to consult appropriate professionals for legal and tax matters.

Client Decisions: You acknowledge that you make all final decisions regarding your real estate transaction, including decisions regarding pricing, offers, counteroffers, repairs, contingencies, and closing. We are not liable for the consequences of your decisions.

Force Majeure: We are not liable for any failure or delay in performing our obligations due to causes beyond our reasonable control, including natural disasters, acts of government, pandemics, strikes, or other force majeure events.

WARRANTY DISCLAIMERS

Our services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Flat Fee Realty disclaims all warranties, express or implied, including but not limited to:

Implied Warranties: We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Transaction Success: We make no warranty or representation that your property will sell, that you will find a property to purchase, that any transaction will close, or that any particular price or terms will be achieved.

Service Availability: We do not warrant that our services will be uninterrupted, timely, secure, or error-free. Services may be interrupted for maintenance, updates, or due to circumstances beyond our control.

Information Accuracy: We do not warrant the accuracy, completeness, reliability, or timeliness of any information provided, including property listings, market data, or transaction information. Information is subject to change without notice.

Results: We do not warrant any specific results from use of our services. Real estate outcomes depend on numerous factors beyond our control, and past performance or experience does not guarantee future results.

Third-Party Services: We disclaim all warranties related to third-party services or products that may be used in connection with your real estate transaction.

Technology: We do not warrant that any technology platforms, websites, or communication systems used in providing services will be free from viruses, errors, or other harmful components.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above disclaimers may not apply to you. You may have additional rights under applicable consumer protection laws.

GOVERNING LAW

These Terms of Service and any disputes arising out of or related to our services shall be governed by and construed in accordance with applicable federal law and the laws of the jurisdiction where services are primarily performed, without regard to conflict of law principles.

Any legal action or proceeding arising out of or related to these Terms of Service or our services must be brought exclusively in the courts of competent jurisdiction in the location where services are primarily performed, and you consent to the personal jurisdiction of such courts.

In the event that any provision of these Terms of Service is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.

These Terms of Service, together with any individual service agreement you enter into with Flat Fee Realty, constitute the entire agreement between you and Flat Fee Realty regarding our services and supersede all prior or contemporaneous communications, agreements, and understandings, whether written or oral.

No waiver of any term or condition of these Terms of Service shall be deemed a continuing waiver of such term or condition or a waiver of any other term or condition. Our failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision.
